Having an accident can be a very confusing time, and we find that there are often lots of questions. Set out below are some of the most common types of questions we are asked:
Can I claim even if the other driver is not traced?
Yes you can under the Motor Insurance Bureau’s Untraced Drivers Agreement, however there are certain criteria which must be fulfilled for a successful claim to succeed.
Do you deal with cases nationally?
Yes. We operate nationally and help clients across the UK.
How long does it take?
It depends entirely on the type of case, and the nature of the injury sustained. However, in less serious cases, we typically find that the average MIB can take between 6-12 months to conclude.
Will I have to attend a medical examination?
Yes. In order to determine the extent of your injury the MIB will require you to attend a medical examination. The purpose of the examination is for the Doctor to determine the extent of your injuries and provide a prognosis as to how long your symptoms will last for. This report is then used by the MIB to value your injuries.
Should I always report an accident to the police?
Yes. The MIB will always insist upon evidence that an accident has been reported to the Police and will often reject a claim if this has not occurred, so therefore always report an accident to the police and retain the Crime Reference Number supplied.
How much do you charge?
It varies depending upon the type of accident. If the driver of the other vehicle is insured or traced, this means that we are able to recover our costs from the MIB or the other drivers insurers which means that we will be able to act on your behalf on no win no fee basis. By contrast if the other driver is untraced, we are unable ( apart from a small contribution paid by the MIB ) to recover our costs in full, it is for this reason we undertake this type of case on a contingency agreement whereby we are paid 25% plus vat of the compensation we recover on your behalf.
How many years do I have to make a successful claim under the MIB’s Untraced Drivers Agreement?
The accident must have occurred within the last 3 years, for you to succeed with a claim under the MIB’s Untraced Drivers Agreement.
